When can a party approach the Supreme Court in an IBC matter?+
Appeals from NCLAT orders lie to the Supreme Court under Section 62 of the IBC on questions of law. The Supreme Court has also entertained SLPs from NCLAT in exceptional cases involving questions of law of public importance. Timeline is critical in IBC matters — delays in filing can result in the resolution process completing before the appeal is heard.
What is a Special Leave Petition (SLP) and when is it appropriate?+
An SLP under Article 136 of the Constitution allows the Supreme Court to grant leave to appeal against any order of any court or tribunal. It is not an appeal as of right — the court exercises discretion. SLPs are appropriate when the High Court or NCLAT has made an error of law, when there are conflicting judgements, or when the matter involves constitutional questions.
Can a foreign company or foreign arbitral award be enforced through the Supreme Court?+
Foreign arbitral awards are enforced in India under the New York Convention through commercial courts at first instance. The Supreme Court gets involved only if there is a significant question of law or a constitutional issue in the enforcement proceedings. For international matters involving Indian statutory violations, the Supreme Court has jurisdiction.
