The BNSS repeals and replaces the CrPC 1973 from 1 July 2024. Important savings clauses: (i) All actions, orders, notifications under the old CrPC remain valid. (ii) Cases where trial (examination of witnesses) has ALREADY STARTED continue under the old CrPC — they do not shift to BNSS. (iii) Pending appeals and revisions under CrPC continue under CrPC. (iv) Existing sentences remain valid. In practice, this means dual systems operate for several years — new cases filed after 1 July 2024 follow BNSS; old cases continue under CrPC.

Bharatiya Nagarik Suraksha Sanhita, 2023 · Section 531

(1) The Code of Criminal Procedure, 1973 (2 of 1974) is hereby repealed. (2) Notwithstanding such repeal— (a) any action taken, decision made, order passed, rule made, notification issued, appointment made or anything done under the Code of Criminal Procedure, 1973 shall be deemed to have been made, issued, passed or done under the corresponding provisions of this Sanhita; (b) any right, privilege, obligation or liability acquired, accrued or incurred under the Code of Criminal Procedure, 1973 shall not be affected by such repeal; (c) any investigation, inquiry or trial or any other proceeding commenced under the Code of Criminal Procedure, 1973 and pending immediately before the date of commencement of this Sanhita shall continue to be governed by the provisions of the Code of Criminal Procedure, 1973 as in force immediately before such commencement and shall be disposed of accordingly: Provided that every inquiry or trial in which the examination of witnesses has been commenced, shall be continued and concluded under the said Code; (d) any sentence awarded, order or judgment passed or made under the Code of Criminal Procedure, 1973 shall continue to be in force until altered or superseded by any competent authority or until expiry thereof; (e) any appeal or revision application or other proceeding pending before any court on the date of commencement of this Sanhita shall be disposed of in accordance with the provisions of the Code of Criminal Procedure, 1973.
