Does copyright need to be registered in India to be enforceable?+

No. Copyright subsists automatically upon creation under the Copyright Act 1957. However, copyright registration creates a public record and is admissible as evidence in infringement proceedings. Courts give significant weight to registered copyright in injunction applications. We recommend registration for all commercially important works.

Who owns copyright in software developed by an employee?+

Under Section 17 of the Copyright Act 1957, if a work is made by an author in the course of their employment under a contract of service, the employer is the first owner of copyright in the absence of agreement to the contrary. Employment contracts should explicitly state this. For contractors and freelancers, the position is different — work-for-hire does not automatically vest copyright in the client.

What remedies are available for copyright infringement in India?+
