Enforcing a Court Decree in India: Why You Win the Battle But Lose the War

Winning a court case and recovering the awarded amount are two very different challenges in India. The enforcement infrastructure — execution proceedings, attachment, contempt — is available but requires the same strategic attention as the original litigation. **The Order XII Framework: Execution** A court decree is enforced through an execution petition filed in the court that passed the decree (or the court in whose jurisdiction the judgment debtor's assets are located). The execution petition initiates the following potential enforcement mechanisms. **Attachment of Property** The most common enforcement mechanism is attachment of the judgment debtor's property — immovable property (land, buildings) and movable property (bank accounts, vehicles, shares, receivables). The attached property is placed under court custody and can be sold by public auction to satisfy the decree. **Garnishee Order** A garnishee order directs a third party (typically a bank) that holds money on behalf of the judgment debtor to pay that money to the decree-holder instead. Bank account attachments through garnishee orders are among the most effective enforcement mechanisms for money decrees. **Arrest** In civil proceedings, a judgment debtor can be arrested and held in civil prison if the court is satisfied that the debtor has the means to satisfy the decree but is wilfully refusing to do so. This is an extraordinary remedy used sparingly. **Contempt** For orders of specific performance, injunctions, and orders requiring a party to do or refrain from doing something, non-compliance can be punished as contempt of court — carrying imprisonment and fine. Contempt is a powerful tool in cases where the decree requires a specific action rather than payment. **Receivership** For complex business assets, the court can appoint a Receiver to manage and realise assets for the benefit of the decree-holder. This is particularly useful where the judgment debtor is attempting to dissipate assets. **The Asset Tracing Challenge** Before filing an execution petition, effective enforcement requires intelligence about the debtor's assets — bank accounts, real property, vehicles, shares, receivables. A fresh suit must be filed in the foreign jurisdiction on the basis of the Indian decree. Conversely, foreign judgments from "reciprocating territories" (a list of countries including UAE, UK, Singapore) can be enforced in India through Section 44A of the Code of Civil Procedure.
