The Factories Act, 1948

This act has been repealed and replaced by Occupational Safety, Health and Working Conditions Code, 2020. It may still be referenced in ongoing matters. This reference is maintained for academic and archival purposes.

Governed the regulation of labour in factories, covering health, safety, welfare, working hours, and employment of women and young persons. While largely superseded by the OSH Code 2020, the Factories Act remains in force in States that have not yet adopted the new Code and continues to govern historical compliance issues.

Applicability: manufacturing process employing 10+ workers (power) or 20+ (no power)

Working hours: 48 hours per week, 9 hours per day maximum
Overtime: twice the rate of wages
Women and young persons: restrictions on working hours and processes
Annual leave with wages: one day per 20 days of work
