Plain English Explanation

A judgment must: (i) Be written in the court's language. (ii) Contain the issues decided, the decision, and reasons. (iii) Specify the exact offence and section under which the accused is convicted. (iv) State the sentence imposed. (v) If acquittal, state the offence and direct release. The judge must sign and date the judgment in open court. NEW: The judge can now deliver the judgment by pronouncing only the operative part (the order), without reading out the entire judgment aloud — a practical modernisation.

(1) Every judgment referred to in section 328— (a) shall be written in the language of the court; (b) shall contain the point or points for determination, the decision thereon and the reasons for the decision; (c) shall specify the offence (if any) of which, and the section of the law under which, the accused is convicted, and the punishment to which he is sentenced; (d) if it be a judgment of acquittal, shall state the offence of which the accused is acquitted and direct that he be set at liberty. (2) When the conviction is under the Bharatiya Nyaya Sanhita, 2023 and it is doubtful under which of two sections, or under which of two parts of the same section, of that Sanhita the offence falls, the court shall distinctly express the same, and pass judgment in the alternative. (3) (a) A judgment may be delivered by the judge in open court by pronouncing the operative part of the judgment or by reading out the whole judgment. (b) Where the judgment is in writing, a copy thereof shall be made available to the parties. (c) Nothing in this sub-section shall be construed as requiring the court to deliver the entire judgment verbally in open court. (4) The judgment shall be dated and signed by the presiding officer in open court at the time of pronouncing it.
